18 U.S.C. §2257 Statement

Smutlore publishes written fiction. This statement explains why the record-keeping requirements of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 do not apply to the material on this site, and what records we do keep.
No visual depictions of actual conduct
The requirements of § 2257 attach to visual depictions — photographs, film and video — of actual sexually explicit conduct by real performers.
Smutlore contains no such material. Everything published here is text: fictional prose about fictional adult characters. The site does not accept photographic or video uploads from anyone, and no such feature exists.
Cover images are illustrations generated for each work. They are not photographs, they do not depict real people, and they do not depict sexually explicit conduct.
On that basis no performer records arise, and Smutlore holds none. If material outside this model ever appears here, or if any material is determined to fall within § 2257, we will either maintain the required records for it or remove it.
Author age and identity
Open author sign-up is not available. Publishing access is granted individually by the operator.
Before anyone is granted publishing access, and before any payment to a writer, we verify identity and age. Writers must be at least 18 and legally able to write and publish adult fiction where they live. These records support adult-content compliance, accountability and fraud prevention, and are kept separately from ordinary account data.
Records for the licensed catalogue
The current catalogue is licensed from its original authors rather than submitted through accounts, and we keep a provenance record for each work: who gave permission, how to reach them, when it was given, what it covers, and where the agreement is held.
That record is a publication gate, not a filing habit. The tooling that loads works into the catalogue refuses anything the record does not cover, so any published work can be traced back to the permission it rests on. A catalogue that cannot show why it holds a work cannot answer a rights complaint.
Records are produced to rights holders, partners and authorities where lawfully required.
